It is not a 5 V part — if the rest of the CAN bus runs at 5 V, check the common-mode range and bus pin tolerance; the transceiver's bus pins are specified for the 3.3 V domain. The 1 Mbps data rate covers the full CAN 2.0 high-speed specification.
